Duluth sits in north Gwinnett County with the Chattahoochee River forming its northern edge. The city grew up around the railroad, which arrived in 1871 and gave Duluth its name, and today it is known for its town center, Sugarloaf Country Club and the Southeastern Railway Museum, with Gas South Arena just outside city limits. Duluth is about an hour from our Athens base and part of our Gwinnett service area.

How Duluth Permits a Pool

Inside city limits, pools are permitted by the City of Duluth Planning and Development Department at City Hall on Main Street. A pool needs a building permit before any land disturbance, and the application includes a site plan, building plans and a pool affidavit. The city’s pool requirements shape the design from the start:

  • Pools go in the rear yard, at least five feet from side and rear property lines, and not in easements.
  • Encroachments into buffers are not approved, and the site plan must show stream buffers, the 100-year floodplain and Chattahoochee River setbacks where they apply.
  • The barrier must be at least four feet tall with self-closing, self-latching gates. A house wall can be part of the barrier if doors to the pool are alarmed or the pool has a power safety cover.
  • On septic lots, Gwinnett Environmental Health approves the pool location first, and the pool must stay ten feet from the tank and drain field.

Some homes with a Duluth address are outside city limits, and those are permitted by Gwinnett County. We confirm which applies before drawing anything.

Designing Within the Rules

We start with your survey and a site visit, then build a 3D design rendering that places the pool, spa and equipment where they meet setbacks and buffers and still work with the house. An automatic safety cover is often the cleanest way to meet the barrier rule where the house wall faces the pool.
